lots and buildings shall be used for residential purposes only.

No building
shall be more than 2-1/2 stories tall.

No building
shall be located closer than 20 feet from the front lot line.

No building
shall be located closer than 5 feet from the side lot line.

Owners
must maintain 12 feet between houses.

Swimming
pools must be at least 10 feet from a lot line.

Swimming
pools must be in the rear of the main dwelling.

Swimming
pools must be no more than 2 feet above ground.

Architectural
Review Board must review all improvements, additions, alterations,
fences, driveways. (Please see covenants for more important
information)

Exterior
color scheme is regulated by ARB

Exterior
finish is regulated by ARB
-
Outbuildings
must be of same appearance as residence including shingles and
trim.

Fences
are regulated by ARB and shall not exceed 6 feet tall.

Fencing
facing the street must be ornamental in nature.

Lot
elevation may not be changed if it adversely affects surrounding
lots.

Each
house must have a prominent house number displayed.

No structure
of a temporary nature shall be erected or allowed to remain on
any lot, and no trailer, RV, shack, tent, garage, barn or other
structure of similar nature shall be used as a residence, either
temporarily or permanently

Only "For
Rent" and "For Sale" signs may be displayed.
-
"For
Rent" and "For Sale" may not exceed six feet square
in size.
-
No more
than 2 signs are permitted per property at a time.
-
Antennas
may not be more than 10’ above the roof line.
-
Dishes
should be concealed from the street when possible.
-
No mining
or drilling on the property.

Air
and water pollution is regulated. (Please see covenants for
more important information)

Trash
must be kept and stored in sanitary containers. except on the day
of pick-up.

Trash
containers should be kept in a garage or on the patio. (Not visible
from adjacent homes or street)
-
Removal
of trees from property is regulated by Town of Summerville and
ARB.

AESTHETICS:
Garbage Cans, Equipment, Coolers, Fuel Tanks, and like items shall
be walled in to conceal them from the view of neighboring lots
or the street. No fences, Awnings, Ornamental screens, Screen Doors,
Sunshades or walls of any nature may be erected unless approved
by ARB

Only
Dogs, Cats, fish and birds inside cages are permitted. Commercial
breeding is not allowed.

Pets
(Dogs, Cats, Birds) are limited to two per lot.
-
All
pets must be under the control of a responsible person and obedient
to that persons command if outside the house or fenced in area.
-
Utilities
must be contacted three days prior to digging to mark utility lines
-
Each
owner must keep property in good repair. This includes: Seeding,
watering and mowing lawns. Pruning and cutting trees and shrubs
and painting buildings as needed.

Outdoor
clothes drying is only permitted on a retractable umbrella type
device which is removed from sight when not in use.
-
The
sale or use of fireworks within Summerville Place is prohibited.
-
The
use or discharge of firearms of any type is prohibited.
-
All
hunting is prohibited in Summerville Place.
-
No noxious,
offensive or illegal activity is permitted. Nothing which can cause
embarrassment, discomfort, annoyance or nuisance to the neighborhood
or owners is permitted.
-
Caution
must be used with lawn chemicals that any runoff will not harm
aquatic life. Read instructions carefully! Street drains go directly
to the ponds.
-
No overnight
parking on streets is permitted.
-
No parking
is allowed anywhere except in a garage or on a driveway.
-
Garage
doors shall remain closed except when entering, exiting or owner
is in yard.
-
No trailer,
Trailer house, Recreational Vehicle, Commercial Vehicle, Bus, boat,
Boat trailer, Truck (other than vans or pick-ups) mobile home or
any habitable motor vehicle of any kind shall be kept more than
three nights on a property. These vehicles may be stored behind
a dwelling if screened from view of surrounding lots and streets
in accordance with ARB guidelines.

Any
person who violates these covenants may be responsible for attorneys
fees if person or organization enforcing the covenants prevails.

Failure
to enforce a covenant is not a waiver to do so in the future.
